TERMS OF SERVICE ================ Entity: Wavelength Intelligence LLC Last updated: June 13, 2026 These Terms of Service ("Terms") are a legal agreement between you and Wavelength Intelligence LLC ("Wavelength", "we", "us") governing your use of the Wavelength app and related services. By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the app. ELIGIBILITY ----------- You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Wavelength. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. YOUR ACCOUNT ------------ - Wavelength is passwordless: you sign in with your email and a one-time verification code. You are responsible for keeping access to your email and device secure. - You agree to provide accurate information and to keep your profile up to date. - You are responsible for activity that happens through your account. Notify us promptly of any unauthorized use. YOUR CONTENT ------------ You retain ownership of the content you create or upload - your captions, comments, and any photos you choose to post ("Your Content"). By posting, you grant Wavelength a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely to operate and improve the app (for example, showing your posts in feeds and on your profile). This license ends when you delete Your Content or your account, except for copies retained in routine backups for a limited time or where required by law. You represent that you have the rights to the content you post and that it does not violate the law or anyone's rights. You are solely responsible for Your Content. MUSIC AND THIRD-PARTY CONTENT ----------------------------- Song metadata, cover artwork, and 30-second previews are provided through Apple's iTunes Search API and belong to Apple and the respective rights holders. They are made available for personal, non-commercial discovery within the app. You may not download, copy, redistribute, or otherwise use that content except as the app allows. See our Third-Party Notices and Copyright & DMCA in the app (Settings > Legal & policies). ACCEPTABLE USE -------------- Your use of Wavelength is also governed by our Acceptable Use Policy (in the app: Settings > Legal & policies), which prohibits, among other things, abuse, harassment, illegal content, infringement, scraping, reverse engineering, and interfering with the service. Violations may result in content removal or account suspension or termination. OUR RIGHTS ---------- Wavelength and its name, logo, design, and software are owned by Wavelength Intelligence LLC and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the app for its intended purpose, subject to these Terms and the License Agreement (EULA) (in the app: Settings > Legal & policies). SERVICE CHANGES AND AVAILABILITY -------------------------------- We may add, change, or remove features, and we may suspend or discontinue the app at any time. We aim for reliable service but do not guarantee it will be uninterrupted or error-free. TERMINATION ----------- You may stop using Wavelength and delete your account at any time from Settings > Security & privacy. We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy (in the app: Settings > Legal & policies), or to protect the service or other users. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitations of liability) will survive. DISCLAIMERS ----------- The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. LIMITATION OF LIABILITY ----------------------- To the fullest extent permitted by law, Wavelength and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the past 12 months (if any) or USD 50. INDEMNIFICATION --------------- You agree to indemnify and hold Wavelength harmless from claims and expenses arising out of Your Content, your use of the app, or your violation of these Terms or the law. GOVERNING LAW AND DISPUTES -------------------------- These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. You agree that disputes will be resolved in the state or federal courts located in Delaware, unless applicable law gives you the right to bring a claim elsewhere. Nothing in these Terms limits any non-waivable consumer rights you have under your local law. APPLE APP STORE TERMS --------------------- If you obtained the app from the Apple App Store, the Apple-specific terms in our License Agreement (EULA) (in the app: Settings > Legal & policies) also apply; Apple is a third-party beneficiary of those terms. CHANGES TO THESE TERMS ---------------------- We may update these Terms. We will update the "Last updated" date and, for material changes, provide additional notice.
